Mototo LLC ("Mototo," "we," "us," or "our") is committed to protecting the privacy of individuals who use the Mototo mobile application ("App"). This Privacy Policy explains what information we collect, how we use it, how we share it, and your rights regarding your personal information.

By using the App, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy.

1.3 Information From Third Parties

We may receive information from third-party services used in connection with the App, including Firebase (authentication and database services), Apple (App Store), and Google (Play Store).


2. How We Use Your Information

We use the information we collect for the following purposes:

  1. Provide the Service: To connect Riders with Drivers, display ride details, calculate fares, and facilitate the completion of rides.
  2. Location Services: To determine your pickup location, match you with nearby Drivers, display your position on the map in real time, and calculate distance-based fares.
  3. Communications: To send you ride status notifications, order updates, and respond to your support inquiries.
  4. Safety and Security: To detect and prevent fraud, abuse, and other harmful activity, and to investigate violations of our Terms of Service.
  5. Improve the Service: To understand how the App is used, diagnose technical issues, and develop new features.
  6. Legal Compliance: To comply with applicable laws, regulations, legal processes, or government requests.
  7. Referrals: To track and attribute referral signups from Driver QR codes.


3. Location Data

This section is important. Please read carefully.


3.1 Rider App

The Rider app collects your precise GPS location while the app is in use (foreground only). This is necessary to determine your pickup location, display your position on the map, match you with nearby Drivers, and calculate your fare. You can disable location access at any time through your device settings, but the App will not function properly without it.


3.2 Driver App

The Driver app collects precise GPS location while the app is in use and in the background when the Driver is online and available for rides or actively completing a delivery. Background location is necessary so that the system can match Drivers with nearby Riders and provide real-time tracking during active rides. Drivers can go offline at any time to stop location sharing.


3.3 How Location Data Is Used

Location data is used exclusively for the operation of the Service. We do not sell location data to third parties. We do not use location data for advertising. Location data is stored in our database for the duration of each ride and retained in ride history records.


4. How We Share Your Information

We do not sell your personal information. We may share your information in the following limited circumstances:


4.1 Between Riders and Drivers

When a ride is matched, we share limited information between the Rider and Driver to facilitate the ride. This may include first name, approximate location, and pickup/drop-off addresses.


4.2 Service Providers

We use third-party service providers to operate the App. These providers have access to your information only to perform services on our behalf and are contractually obligated to protect it:

4.3 Legal Requirements

We may disclose your information if required by law, subpoena, court order, or other legal process, or if we believe in good faith that disclosure is necessary to protect the rights, property, or safety of Mototo, our Users, or the public.


4.4 Business Transfers

If Mototo is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.


5. Data Storage and Security

Your information is stored on Google Cloud Platform (Firebase) servers located in the United States (us-east4 region). We implement industry-standard security measures to protect your data, including encrypted data transmission (TLS/SSL), Firebase Authentication, and Firestore security rules.

However, no method of electronic storage or transmission is 100% secure. We cannot guarantee the absolute security of your information.


6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. Ride history is retained for operational, safety, and legal purposes.

If you delete your account, we will delete or anonymize your personal information within 30 days, except where retention is required by law or for legitimate business purposes (such as resolving disputes or enforcing our Terms).


7. Your Rights

You have the following rights regarding your personal information:

  1. Access: You may request a copy of the personal information we hold about you.
  2. Correction: You may update or correct your information through the App's profile settings or by contacting us.
  3. Deletion: You may request deletion of your account and personal information by using the "Delete Account" feature in the App or by contacting us at support@themototo.com.
  4. Opt-Out of Communications: You may opt out of promotional communications by contacting us. Note that you cannot opt out of ride-related notifications while using the Service.
  5. Location: You may disable location services through your device settings at any time. Note that this will prevent the App from functioning properly.

To exercise any of these rights, contact us at support@themototo.com. We will respond to your request within 30 days.


8. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  1. Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share it.
  2. Right to Delete: You may request that we delete your personal information, subject to certain exceptions.
  3. Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights.
  4. No Sale of Personal Information: We do not sell your personal information as defined by the CCPA.

9. Children's Privacy

The App is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected information from a child under 18, we will delete it promptly. If you believe a child under 18 has provided us with personal information, please contact us at support@themototo.com.


10. Third-Party Links

The App may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to read the privacy policies of any third-party service you interact with.


11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Changes will be effective upon posting to the App or website. The "Last updated" date at the top of this page indicates when the policy was most recently revised. Your continued use of the App after any changes constitutes your acceptance of the updated policy.
